How long does an ESA letter take in most states?

Which states require a waiting period before an ESA letter?

A handful of states set rules that add time. Some require a client provider relationship of at least 30 days, and two set in person requirements for certain practitioners. The table summarizes these rules as of October 2026.

Why do some states require 30 days?

Lawmakers in these states wanted ESA documentation to come from a clinician who knows the person, not from a quick online form. California's rule took effect January 1, 2022, Arkansas passed its law in 2023, and Louisiana's took effect August 1, 2024. Each also requires the clinician to be licensed where the letter is issued and to list license details on it.

A 30 day rule does not mean you wait a month before anyone talks to you. Your first session starts the clock, and the clinician completes the evaluation and documentation once the period has passed. If you live in one of these states, check your state's ESA rules before you set a move in date.

Colorado's rule works differently. It sets no number of days, but a Colorado psychologist, counselor, social worker or therapist must have met you in person before making a written finding. Colorado also passed HB26-1045, effective August 12, 2026, which presumes that permitting an assistance animal, including an ESA, is a reasonable accommodation.

Can you get a same day ESA letter?

Sometimes, but nobody honest can promise one. In a state without a waiting period, a clinician may finish the review and issue a letter on the day you complete the assessment. That depends on their schedule, your answers and whether a conversation is needed.

What can slow your ESA letter down?

Most delays are small and easy to avoid. If you already see a therapist, you can also ask your existing provider for a letter, which can be quicker in a state with a 30 day rule because the relationship already exists. These are the common causes of delay:

  • An assessment with blank or very short answers, which leads the clinician to ask follow up questions.
  • A missed call or video session, if your state or clinician requires one.
  • Weekends and holidays, since response times are counted in business days.
  • Adding a second animal after the evaluation, which may need a new review.
  • Living in a state with a relationship period or an in person rule.

How long does an ESA letter last, and when should you renew?

Federal law sets no fixed expiration date, but many housing providers expect recent documentation. Iowa's written finding is valid for 12 months or the lease term, whichever is longer, and Arkansas requires a yearly clinical evaluation for emotional support dogs.

If your lease renews on a schedule, start a renewal evaluation a few weeks before you need it. A renewal is $79 and follows the same timing as a first letter in most states.

What should you do if your move in date is close?

Start as soon as you know you will need documentation, and mention your deadline in the assessment. In a state with no waiting period, a few days is usually enough. In California, Arkansas, Louisiana or Montana, talk to your housing provider early so they know a letter is on the way.

It also helps to know where an ESA letter stands in 2026. HUD's May 22, 2026 memo says its fair housing office will find reasonable cause only for individually trained animals, so untrained ESAs are no longer presumed reasonable in federal enforcement. The Fair Housing Act and private lawsuits are unaffected, and agencies in California, Massachusetts, South Carolina and Maryland say their state laws still protect untrained ESAs.
