What Florida law requires for an ESA letter
If a disability is not readily apparent, a housing provider may request reliable information, including from a health care practitioner or Florida telehealth provider with personal knowledge of the disability; an out of state practitioner's information on the disability counts only if that practitioner has provided in person care to the tenant at least once. Providers may not request diagnosis, severity or medical records, may not charge extra for the ESA or require a specific form, and an online registration or certificate alone is insufficient. Falsifying ESA documentation or knowingly misrepresenting a disability related need is a second degree misdemeanor plus 30 hours of community service (s. 817.265).

How HUD's 2026 change affects Florida renters
On May 22, 2026, HUD's fair housing office announced it will find reasonable cause in animal accommodation complaints only when the animal is individually trained to perform disability related tasks, and it withdrew its older ESA guidance. The Fair Housing Act itself, HUD's regulation at 24 CFR 100.204 and your right to bring a private lawsuit within two years did not change.
Florida's ESA rules refer back to federal law, so the HUD change creates real uncertainty here. § 760.27 defines an ESA as an animal that does not require training, but its anti discrimination clause applies 'to the extent required by federal law, rule, or regulation', so Florida's protection is pegged to federal law (the FHA statute itself is unchanged by HUD's 2026 memo). A strong letter from a clinician who evaluated you, plus a polite written request, gives you the best chance with a Florida landlord.
