What Virginia law requires for an ESA letter

If the disability or need is not obvious or known, a housing provider may ask for reliable documentation of the disability and disability related need, including from anyone with whom the person has or had a therapeutic relationship: a mental health service provider, a state licensed, certified or registered individual or entity serving people with disabilities, a free peer support group member, or a caregiver, reliable third party or government entity with actual knowledge. No pet fee, deposit or extra rent may be charged, and since 2023 a listed person who provides fraudulent supporting documentation commits a prohibited practice under the Virginia Consumer Protection Act.

How HUD's 2026 change affects Virginia renters

On May 22, 2026, HUD's fair housing office announced it will find reasonable cause in animal accommodation complaints only when the animal is individually trained to perform disability related tasks, and it withdrew its older ESA guidance. The Fair Housing Act itself, HUD's regulation at 24 CFR 100.204 and your right to bring a private lawsuit within two years did not change.

Virginia renters have an extra layer of protection: Va. Code § 36-96.1:1 defines assistance animals to include those providing emotional support and states an assistance animal 'is not required to be individually trained or certified.'
