For housing, an assistance animal includes an animal that a physician, psychologist, physician associate, nurse practitioner, licensed social worker, licensed professional counselor or other licensed health professional with knowledge of the disability related need has determined necessary to mitigate the effects of a disability. Housing providers must permit it unless it poses a direct threat, would cause substantial physical damage or would substantially interfere with others' reasonable enjoyment, and may not charge a fee or security deposit, though the tenant is liable for damage. How HUD's 2026 change affects Maine renters

On May 22, 2026, HUD's fair housing office announced it will find reasonable cause in animal accommodation complaints only when the animal is individually trained to perform disability related tasks, and it withdrew its older ESA guidance.
