What Kentucky law requires for an ESA letter

Unless the need is readily apparent, a landlord may request reliable documentation from a person with whom the tenant has a therapeutic relationship: a Kentucky licensed LCSW, professional counselor, APRN, psychologist or physician who maintains an active practice in Kentucky (a tenant moving from another state may use a provider licensed there with an ongoing relationship); providers whose primary service is selling accommodation letters do not count, and landlords may independently verify documents. No pet fee, deposit or added rent may be charged. Knowingly misrepresenting a need, making false statements to obtain documentation, or providing documentation primarily for a fee is a violation with a fine up to $1,000.

How HUD's 2026 change affects Kentucky renters

On May 22, 2026, HUD's fair housing office announced it will find reasonable cause in animal accommodation complaints only when the animal is individually trained to perform disability related tasks, and it withdrew its older ESA guidance. The Fair Housing Act itself, HUD's regulation at 24 CFR 100.204 and your right to bring a private lawsuit within two years did not change.

Kentucky renters have an extra layer of protection: KRS 383.085(1)(a) defines assistance animal to include an emotional support animal that alleviates symptoms or effects of a disability, with no training requirement. KRS 258.500's 2024 face to face in office rule applies to assistance dog documentation; ESAs in rental housing remain governed by KRS 383.085.
